Electronic Banking Agreement
This Electronic Banking Agreement (the “Agreement”) governs your use of the Scribner Bank’s Electronic Banking (the “Service”). By subscribing to the Service you agree to the terms of the Agreement. Please read this Agreement carefully and keep a copy for your records.
In the Agreement, “you” or “your” refers to the person(s) subscribing to or using the Service; “we” or “our” refers to the Bank and any agent, independent contractor, designee, or assignee the Bank may, in its sole discretion, involve in the provision of the Service.
Hours of Operation | You ordinarily can participate in our Electronic Banking 24 hours a day – 7 days a week. However, we reserve the right to suspend our Service from time to time as we deem necessary. All times noted throughout this document are Central Time (CT). |
Transaction Posting | Transactions between Scribner Bank accounts entered in the Service on or before 5:00 p.m. on any business day will be posted on the same day. Transactions between Scribner Bank accounts entered in the Service on weekends, federal holidays or after 5:00 pm on a business day will be posted by the end of the next business day. |
The Service | You may use the service through an Internet connection or mobile connection to obtain account balances and transaction information. You may also use the service to obtain statements on your account, view activity and to transfer money between your accounts. However, transfers from your savings and Money Market accounts are considered pre-authorized transfers and pre-authorized transfers are limited to 6 pre authorized withdrawals each monthly statement period, of which may be by check, draft, debit card or similar order made to third party. Examples of transactions that fall within the six per month limitation are ACH debits and transfers from your savings and money market at the telephone request of the customer made directly to a bank employee, checks payable to third parties, online transfers and transactions made with an ATM/Debit (point-of-sale) card. Examples of unlimited transactions are pre authorized transfers for the purpose of paying loans at the same institution, transfers or withdrawals made by mail, messenger, ATM or in person (withdrawals and transfers made to another account of the depositor at the same institution), and withdrawals initiated by telephone and consummated by a check mailed to the depositor. In addition, you may use your electronic device to electronically direct us to make payments from your Account to third parties (“Payees”) that you have selected in advance to receive payment through the Service. You may make payments through the Service to any business, merchant, or professional that generates a bill or invoice for products or services provided to you on your behalf and that has an address we can verify. You also may make payments through the Service to individuals, family, or friends for non-business purposes. |
Service Fees | The basic internet banking service is free. Please refer to our fee schedule for details. |
Your User Name and Password | During enrollment you will create a User Name and Password specific to you. The User Name must be 4 to 20 characters with one alpha and one numeric character. Your password must be 8 to 50 characters in length, with one uppercase alpha, one lowercase alpha, one numeric character and one special character. You authorize us to follow any instructions entered through the Service using your User Name and Password. Because your User Name and Password can be used to access funds in your accounts, you should treat them with the same secrecy and care that you would with any other sensitive personal financial information. You agree not to give your User Name or Password, or make them available, to any person not authorized to access your accounts. If you permit other persons to use your login credentials, you are responsible for any transactions they authorize. |
Enhanced Login Security | As a user of this Service you will be required to be enrolled in the Enhanced Login Security. Enhanced Login Security is an online security feature that will provide you additional protection from fraud and identity theft. Enhanced Login Security identifies you as the true owner of your accounts by recognizing not only your password, but also the electronic equipment you login from regularly along with a personal greeting and image. If you are not recognized, you will be asked for information that only you know before being allowed access. Upon each login you will view your personal greeting and image on the password screen that you selected upon your first login. Also, when anyone attempts to login to your accounts from a non-private computer, the system will require you to answer a security question that was answered when setting up your online banking access. |
Liability for Failure to Complete Transactions | We will process and complete all transfers properly initiated through the service in accordance with the terms of this Agreement. If we do not complete a transfer to or from your Account or in the correct amount under the terms of this Agreement, we will be liable for your damages which are directly caused by our failure to correctly complete such transfers. However, we will not be liable if:

Equipment | You are responsible for obtaining, installing, maintaining and operating all electronic equipment used through the Service. We are not responsible for any loss, injury, or damage, whether direct, indirect, special or consequential, caused by the Service or the use thereof or arising in any way out of the installation, operation or maintenance of your electronic equipment. |
Notice of Your Rights and Liabilities | We reserve the right to modify the Service at any time. We will not be liable for any such loss incurred by improper use of the Service. Tell us at once if you believe that your User Name or Password has been lost or stolen, otherwise, you are subject loss of funds in your account. Telephoning is the best and fastest way of keeping your possible losses down. If you believe your User Name or Password has been lost or stolen or that someone has transferred or made unauthorized payments from your account, you should: Telephone Scribner Bank at 402-664-2561 or write us at Scribner Bank, PO Box K, Scribner NE 68057. If you tell us within two (2) business days after you discover your User Name or Password has been lost or stolen, you can lose no more than $50 if someone used your User Name or Password without your permission. If you do not tell us within two (2) business days after you learn of the loss or theft of your User Name or Password, and we can prove we could have stopped someone from using your User Name or Password without permission if you had told us, you could lose as much as $500. Also, if your statement shows transfers or payments you did not make or authorize, tell us at once. If you do not tell us within 60 days after the statement was mailed to you or provided electronically, you may not get back any money you lost after the 60 days if we can prove we could have stopped someone from taking the money if you had told us in time. You agree that if you give a sub-user access or your PIN or Password to someone else, you are authorizing them to act on your behalf, and we may accept any instructions they give us to make transfers or otherwise use the Service. |
Error Resolution Notice | In case of errors or questions about your electronic transfers or payment, you should: Telephone Scribner Bank at 402-664-2561 or write Scribner Bank, PO Box K, Scribner, NE 68057, as soon as you can, if you think that your statement is wrong or you need more information about a transfer listed on your statement. We must hear from you no later than sixty (60) days after you received the first statement on which the problem or error appeared.

Access & Agreement | You agree that, when you use the Service, you remain subject to the terms and conditions of your existing agreements with any unaffiliated service providers, including, but not limited to, your mobile or internet service providers and that this Agreement does not amend or supersede any of those agreements. You understand that those agreements may provide for fees, limitations and restrictions which might impact your use of this Service, and you agree to be solely responsible for all such fees, limitations, and restrictions. Neither Scribner Bank nor any of our service providers assume responsibility for the operation, security, functionality or availability of any related network, wireless device or mobile network which you may utilize to access this Service. |
Limitation of Liability | Except as otherwise provided in this Agreement or by law, we are not responsible for any loss, injury, or damage, whether direct, indirect, special or consequential, caused by the Service or the use thereof or arising in any way out of the installation, operation or maintenance of your electronic devices. |
Entire Agreement | This is the complete and exclusive agreement between you and Scribner Bank related to the Service and supplements any other agreement or disclosure related to your account. In the event of a conflict between this Agreement and any of the agreements or disclosures related to your account or any statement by our employees or agent, this Agreement shall control. |
Waivers | No delay or omission by Scribner Bank in exercising any rights or remedies thereunder shall impair such right or remedy or be construed as a waiver of any such right or remedy. Any single or partial exercise or a right or remedy shall not preclude further exercise thereof or the exercise of any other right or remedy. No waiver shall be valid unless in writing and signed by Scribner Bank. |
Assignment | You may not assign this Agreement to any other party. |
Governing Law | This Agreement shall be governed by and construed in accordance with the laws of Nebraska, without regard to the state’s conflicts of law provision. |
Amendments | We can change these terms by giving you notice as required by law. Continued use of our Service by you after notice of a change in terms constitutes acceptance of the change. |
Bill Pay Agreement
BILL PAYMENT AGREEMENT
EFFECTIVE MARCH 1, 2019
This Bill Payment Agreement (the “Agreement”) governs your use of the Scribner Bank’s Bill Payment (the “Service”). By subscribing to the Service or using the Service to make any payment to a third party, you agree to the terms of the Agreement. Please read this Agreement carefully and keep a copy for future reference. By clicking “I agree” or using our bill payment services, you are agreeing to this Bill Payment Agreement.
You may use Scribner Bank Bill Payment to direct Scribner Bank to make payments from your designated checking account to the “Payees” you choose in accordance with this Agreement. The terms and conditions of this Agreement are in addition to the account agreements, disclosures and other documents in effect from time to time governing your account.
Definitions | The words you and your refer to either and all of the persons subscribing to or using the Service. The words we, us and our refer to Scribner Bank. Payee means anyone, including Scribner Bank, you designate and Scribner Bank accepts as a payee. |
Hours of Operation | Our business days are Monday through Friday, except federal holidays. Although payments can be initiated only on business days, the Service is available 24 hours a day, seven days a week, except during maintenance periods, for the scheduling of payment orders. |
Transaction Posting | Transactions entered on our website on or before 3:00 pm C.S.T on any business day will be posted on the same day. Transactions entered on our website on weekends, federal holidays or after 3:00 C.S.T. pm on a business day will be posted by the end of the next business day. |
The Service | You may use the Service to electronically direct us to make payments from your account to third parties (Payees) that you have selected in advance to receive payment. You may make payments through the Service to any business, merchant, or professional that generated a bill or invoice for products or services provided to you on your behalf and that has an address we can verify. You may make payments through the Service to individuals, family or friends for non-business purposes. |
How Bill Payments are Made | Bill payments are processed either through an electronic transmission to the payee or by check drawn on your account and mailed to the payee. Payees who receive electronic delivery will receive your payment information which includes your account number on them. All checks are sent through the U.S. mail. |
How to Set Up Payees/Payments | To add a new Payee, select the Payee tab located in the Service or speak to a service representative. You may add a new fixed payment to a Payee by accessing the Service and entering the appropriate information. Most other additions, deletions or changes can be made in writing or by using the Service. Scribner Bank reserves the right to refuse the designation of a Payee for any reason. You may pay any Payee within the United States (including U.S. territories and APO’s/AEO’s. Scribner Bank is not responsible for payments that cannot be made due to incomplete, incorrect or outdated information. You must provide sufficient information about each payee to properly direct a payment to that Payee and permit them to identify the correct account (Payee Account) to credit with your payment. |
Bill Paying Process | To electronically schedule a payment you will be required to select the Payee from a list you create, the amount of the payment and the date on which you would like your payment to be processed. Individual payments may be made in any amount less than $10,000.00. A confirmation number will appear for each payment that has been initiated. |
Single Payments | A single payment will be processed on the business day (generally Monday through Friday, except federal holidays) that you designate as the payment’s processing date, provided the payment is submitted prior to the daily cutoff time of 3:00 pm C.S.T. A single payment submitted after the cutoff time on the designated process date will be processed on the next business day. Payments entered on the weekends, federal holidays or after 3:00 pm C.S.T. on a business day will be posted by the end of the next business day. Bill payment will calculate the estimated arrival date of your payment. This is only an estimate, so please allow ample time for your payments to reach your Payees. Rush payments are also available. Please refer to the fee schedule for the fees related to these payments. You may schedule a payment to be initiated on any future business day, up to 18 months in advance. |
Recurring Payments | When a recurring payment is processed, it is automatically rescheduled by the system. Based upon your selected frequency settings for the payment, a processing date is calculated for the next occurrence of the payment. If the calculated processing date is a non-business date, generally weekends and federal holidays, it is adjusted based upon the following rules:

Canceling a Payment | A bill payment may be changed or cancelled any time prior to the cutoff time on the scheduled processing date. Once the payment is cancelled, the funds will be returned to your account within 1-2 business days. There is no fee for canceling a payment online. |
Rush Delivery | Rush delivery of payments may be scheduled until 3:00 pm. Payments scheduled after 3:00 pm will be processed on the next processing day for the payee. Physical address required for check payment, but not electronic payment. Payment deducted from account when check clears. Electronic payment deducted from account automatically. See fee schedule for rush delivery fees. |
Available Funds | Payments are posted against your balance available for withdrawal, as defined in our Funds Availability disclosure issued at account opening. |
Liability | You will be responsible for any bill payment request you make that contains an error or is a duplicate of another bill payment. Scribner Bank is not responsible for a bill payment that is not made if you did not properly follow the instructions for making a bill payment or you have not provided us with the correct Payee name, address or account information or payment amount. We are not liable for any future failure to make a bill payment if you fail to promptly notify us after you learn that you have not received credit from a Payee for a bill payment or a Payee mishandles or delays in handling payments sent by us. Scribner Bank is not responsible for your acts or omissions or those of any other person, including, without limitation, any transmission or communications facility, and no such party shall be deemed to be our agent. |

Termination | You may terminate your use of the Service at any time by notifying Scribner Bank, customer service at 402-664-2561. You may be asked to provide the request for cancellation in writing within ten (10) days. We may terminate your use of the Service at any time without prior notice. Your access to the Service will be terminated automatically if your account is closed or if access to your account is restricted for any reason. Termination will not affect your liability or obligations under this Agreement. Scribner Bank is not responsible for any fixed payment made before we have had a reasonable opportunity to act on your termination notice. You remain obligated for any payments made by us on your behalf. If the Service is terminated, all payments not yet processed will be canceled. |
Electronic Delivery of Notices | You agree to accept Online Banking and Bill Pay related disclosures in an electronic format. You also agree that you have the necessary equipment for accessing and reviewing the disclosures and you agree to notify us if you change your email address. |

Security Tips
It is the policy of the Scribner Bank to protect your personal information to the best of our ability. We will never contact you and ask for any of this information which includes your name, address, social security number, date of birth or bank account information. In the event you fear any of the above mentioned items may have been compromised, please contact us immediately at (402) 664-2561.
Every year, thousands of people lose money to scams. Scammers will stop at nothing to get your personal information and bank data. If they pressure you to give them your personal information such as your social security number or bank account number – it’s very likely a scam.
10 things you can do to avoid fraud.
- Spot Imposters. Scammers pretend to be someone you trust, such as a government official, relative, charity, or a company you do business with. Never send money or give out your personal information in response to an unusual request. The scam may come as a phone call, e-mail or mail request.
- Do Online Searches. Type a company, product or phone number into your favorite search engine with words like “review,” “complaint” or “scam.” Or search for a phrase that describes your circumstances, such as “IRS Call”.
- Caller ID. It is easy for scammers to fake caller ID information. The name and number you see aren’t always real. If you receive a phone call asking for money or personal information, hang up. If you think the call is genuine, call back to a number that you are familiar with.
- Don’t Pay in Advance. Someone might try to get you to pay a fee in advance for things like debt relief, loan offers or a job. They might say you’ve won a prize, but first you need to pay the taxes or some kind of a fee to get the prize. Once they have your money, they will disappear and you will never realize your promise.
- Payment Method. Credit cards have fraud protection built in. However, wiring money through services such as Western Union or MoneyGram is risky because it is extremely difficult to get your money back. That is also true for prepaid debit cards and gift cards. Honest companies won’t require you to use these methods of payment.
- Talk to someone you trust. Fraudsters want you to make decisions in a hurry. They will often tell you not to tell anyone or they may even threaten you. Slow down, talk to a professional, relative or friend before you give up your money or personal information.
- Hang up on recorded calls. If you receive a call and hear a recorded sales pitch, hang up. These calls are illegal and often the products are phony. Don’t press 1 to speak to an operator or to be removed from the list. That could cause them to contact you more often.
- Be suspicious of free trial offers. Research the company and read the cancellation policy before you sign up for free trial offers. Always review your monthly statement for charges that are unfamiliar to you because some companies sign you up for free products and then bill you every month until you cancel.
- Don’t deposit a check and then wire money back to the issuer. Banks must make funds from deposited checks available to you within days, however, uncovering a bogus check can take weeks. If a check you deposit in your account turns out to be fake, you’re liable for repaying the bank.
- Free scam alerts. Sign up for free scam alerts from the Federal Trade Commission at ftc.gov/scams.
